Town Settles Powder Ridge Lawsuit for $15K

Middlefield officials have agreed to return more than half of Alpine Ridge's deposit after the company sued the town over a failed deal last year.



Town officials agreed this week to return more than half of a $25,000 deposit that Middlefield received from Alpine Ridge LLC last year after the company agreed to buy Powder Ridge ski area.

After announcing the deal was off in October, Alpine , claiming that officials had failed to close the sale of the property on or before August 1, 2011 as required by the sales agreement.

Alpine sought to recover the entire  that was provided to the town in March 2011.

On Wednesday, the Board of Selectmen met in executive session during a special meeting and agreed to return $15,000 of the deposit to Alpine, while keeping $10,000 for the town.

Under the settlement, Alpine will stop any legal action against the town.

Middlefield First Selectman Jon Brayshaw had little to say about the lawsuit on Thursday. "It is what it is," he said.

Alpine officials could not be reached for comment.
